The IPOL trade mark wizard has been designed by experienced trade mark professionals to guide you through the trade mark application process. It is a fully assisted filing service that will automatically file the application directly with the New Zealand Intellectual Property Office.

There are many issues to consider when filing a trade mark application. The IPOL wizard will alert you to the most important issues and will provide help where appropriate.

The IPOL wizard will also provide options to seek additional advice during the application process. If you choose to seek advice your application will be saved and held until the advice is provided.

One of the difficult parts of the trade mark process is defining the field of activity in relation to which the owner uses or intends to use the trade mark. It is important to properly describe the field of activity as the description will define the scope of the legal rights once the trade mark is registered.

The field of activity is defined by lists of goods and services which are classified in accordance with an internationally recognised classification system called the Nice Classification. The Nice classification defines goods and services into 45 different classes. The Nice classification is a difficult system to navigate if you are not familiar with it.

The IPOL wizard assists with the creation of the goods and services lists through a comprehensive search and pick list process. If you create the relevant goods and services lists using the IPOL wizard, the descriptions will be accepted by the examiner at the Intellectual Property Office of New Zealand (IPONZ).

The IPOL wizard provides you with option of choosing IPOL as an Address for Service. The Address for Service is a physical address that is set up to receive any legal notifications relating to the application. It is a good idea to use IPOL Limited as an address for service as it is a stable address that will always be up to date.

The IPOL wizard also allows you to file more than one application at a time as long as both applications use identical descriptions of goods or services. If the descriptions are not identical the applications must be filed separately.

Costs

The official IPONZ charges for a trade mark application are $100 +GST per class per trade mark.

IPOL’s charge for the use of the IPOL Wizard is $150 +GST per trade mark application.
