Trade Mark Infringement

A trade mark registration is infringed by anyone using a trade mark which is the same or confusingly similar to the registered trade mark in relation to goods/services the same or similar to those covered by the trade mark registration.

Trade Mark Applications In Other Countries

Trade marks are territorial. A trade mark registration in New Zealand provides no ownership or protection for the same mark in Australia, or anywhere else.

Renewal of Trade Mark Registration

Trade mark registrations have an indefinite life span provided renewal fees are paid to IPONZ every 10 years.

Full Clearance Search

The basic trade mark search involves a search of the Trade Mark Register for marks which are the same or similar to your mark.

Changes of Trade Mark Owner’s Name or Address

The law requires that any change in the trade mark owner’s details, such as a change of name or address, is recorded on the Trade Marks Register.

Selling/Assigning a Trade Mark

You can assign your trade mark application/registration to others. Often when a business is sold, it involves the sale of goodwill and trade marks.

Anyone aggrieved by the existence of someone else’s trade mark registration can file an application at IPONZ asking that the trade mark registration is removed from the Register, is invalidated and/or is amended.
